
Legends announce temporary restraining order against University Sports Publications

LEXINGTON, KY. - The Lexington Legends obtained a temporary restraining order against University Sports Publications Co., Inc. (USP) of Brooklyn, New York for making false and misleading statements to potential advertisers in a Lexington Legends Baseball publication.
The scam was brought to the attention of the Kentucky Attorney General's office by the Better Business Bureau of Central and Eastern Kentucky and by the Lexington Legends Baseball Club. Under the terms of the Order, USP is prohibited from making any false representations or otherwise violating the Kentucky Consumer Protection act.
"We are very grateful for the quick response from the Attorney General's office and the support from the Better Business Bureau," said Legends General Manager Kevin Kulp. "We are very proud of the partnerships we have with our clients and will not tolerate anyone violating their business climate with false and misleading advertising and solicitations," Kulp added
As alleged, USP made false statements to potential advertisers by telling them that USP was selling advertising space in the Lexington Legends section of a South Atlantic League Yearbook. In fact, no such yearbook exists and the Legends have no arrangement with USP to sell advertising space for the Legends.
The complaint alleges that the acts of USP violate the Kentucky Consumer Protection Act and seeks injunctive relief and civil penalties of $2,000 per willful violation. The lawsuit also seeks to have any monies collected by USP returned to businesses that may have been misled. The investigation is ongoing to determine how many businesses were actually misled.
